USCIS Completes Initial H-1B Electronic Registration Selection Process for Fiscal Year 2022

USCIS has announced that it has received sufficient H-1B quota registrations for the fiscal year 2022, and it has also conducted the random selection/lottery drawing of those registrations. The USCIS also confirmed that it has notified the H-1B petitioners with selected registrations regarding the next steps to take, including the submission of H-1B quota petitions, starting on April 1, 2021 and lasting through at least June 30, 2021.

USCIS also clarifies that the H-1B petitioner’s online USCIS accounts will now show one of the following four (4) updated case status for each H-1B registration: Submitted; Selected; Denied; or Invalidated-Failed Payment.

USCIS further explains that only those cases that are marked ‘Selected’ may proceed with the H-1B quota filing for fiscal year 2022. The cases that are shown as ‘Submitted’ will remain in consideration for possible future selection until the end of the fiscal year 2022, and at that point, all registration statuses will be shown to be: “Selected”, “Not Selected”, “Denied”, or “Invalidated-Failed Payment’.

Furthermore, the USIS clarifies that for those cases that are marked ‘Denied”, it was because USCIS deemed that there were multiple registrations that were submitted by or on behalf of the same registrant/employer for the same beneficiary. If the USCIS denied the submission as a duplicate registration, all registrations submitted by or on behalf of the same registrant for this beneficiary for the fiscal year 2022 are invalid.

For those H-1B registrations that are selected, we do advise the employers to contact our office so we can assist with the rest of the H-1B petition preparation and submission process and to timely file these H-1B quota petitions before the deadline of June 30, 2021.
